AMENDMENT TO DECLARATION OF COVENANTS,
CONDITIONS AND RESTRICTIONS FOR
BLUE MESA RECREATION ASSOCIATION


Filed for record the 27th day of June, A.D., 1974 at 9:35 o’clock a.m. in Book 470, Pages 301-302, Reception Number 300818, by Marian A. Smith, Recorder.


            THIS AMENDMENT, made on the date hereinafter set forth by Blue Mesa, Inc.,


WITNESSETH:

            WHEREAS, Sect. 2, Article V of the Declaration of Covenants, Conditions and Restrictions for Blue Mesa Recreation Association provided that if within nine years of the date of incorporation of the Blue Mesa Recreation Association, the Declarants should develop additional lands within an area lying within five (5) airline miles of the properties described in said Declaration, such additional lands may be annexed to said Properties without the assent of the class A members; and

            WHEREAS, the Declarants have developed additional lands within an area lying within five (5) airline miles of the properties described in said Declaration; and

            WHEREAS, the Declarants have decided to annex said additional properties to the properties included in the said Declaration; and

            WHEREAS, said additional properties are described as follows:

             Blue Mesa Subdivision – Unit II
             Gunnison County, Colorado
             according to the recorded plat thereof


             NOW THEREFORE, Declarants hereby declare that the above described additional properties are annexed to, made subject to and shall be held, sold and conveyed subject to the easements, restrictions, covenants and conditions of the Blue Mesa Recreation Association, which are for the purpose of protecting the value and desirability of, and which shall run with, the real property and be binding on all parties having any right, title, and interest in the described properties or any part thereof, their heirs, successors and assigns, and shall inure to the benefit of each owner thereof, the Declaration of Covenants, Conditions and Restrictions for Blue Mesa Recreation Association dated April 3, 1972, and recorded June 6, 1972, in Book 440 at Page 109 of the records of Gunnison County, Colorado.
